At BAMA Global Logistics Inc., we prioritize transparency and mutual understanding in every shipment. These Terms and Conditions constitute a legally binding agreement between BAMA Global Logistics Inc. and our valued clients. By engaging our freight and cargo transportation services, you acknowledge that you have read, understood, and agreed to be governed by the following provisions.

01 Definitions

In this document, "Carrier" refers to BAMA Global Logistics Inc. "Shipper" (or "Customer") refers to the individual or entity requesting transportation services. "Consignee" refers to the party designated to receive the shipment. "Services" encompasses all freight transportation, cargo handling, and logistics solutions provided by the Carrier.

02 Agreement to Terms

The use of BAMA Global Logistics services, whether initiated via phone, email, or digital portal, signifies unconditional acceptance of these terms. These provisions supersede any prior verbal or written agreements and take precedence over any conflicting terms found on a Shipper’s purchase order or standard documentation.

03 Shipper's Warranties

The Shipper warrants that all cargo is properly packaged, marked, and labeled to withstand the ordinary rigors of transportation. The Shipper must provide accurate descriptions of weight, dimensions, and contents. Failure to disclose hazardous materials or specialized handling requirements may result in immediate service termination or additional surcharges at the Carrier’s discretion.

04 Payment and Charges

Payment for services is due within 15 days of the invoice date unless otherwise specified in a separate credit agreement. BAMA Global Logistics reserves the right to apply accessorial charges for unforeseen events including, but not limited to, detention time, redelivery, or lift-gate requirements. Late payments are subject to a 1.5% monthly interest fee.

05 Limitation of Liability (Freight Liability)

Unless a higher value is declared in writing and additional fees are paid, Bama Global Logistics Inc.'s liability for loss or damage to cargo is limited to $0.50 per pound or $50.00 per shipment, whichever is greater. We are not liable for indirect, incidental, or consequential damages resulting from delays or cargo loss.

06 Cargo Claims Process

Claims for loss or visible damage must be noted on the Proof of Delivery (POD) at the time of receipt. All formal claims must be filed in writing within 48 hours of delivery. Shippers must provide original invoices, photographs of damage, and the signed POD to initiate the review process. Salvage must be retained until the claim is fully resolved.

07 Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal actions must be brought within the jurisdiction of Diamond Bar, CA.

08 Force Majeure

BAMA Global Logistics Inc. shall not be held liable for failure to perform its obligations if such failure results from acts of God, extreme weather, civil unrest, labor strikes, government intervention, or any other circumstances beyond our reasonable control.
